What is Covered?
All insured members are covered against claims for civil damages and legal costs arising out of a claim from a third party (person or organisation) where that third party has suffered some loss, injury or damage as a result of recognised or authorised activities of the Association, anywhere in the world. The cover extends to damage to hired premises, breach of professional duty (such as poor coaching advice), where one member hurts another and any liability arising out of goods sold or supplied, including refreshments.
A rugby referee was held to be negligent for not stopping dangerous play and was held liable for £1.92m damages. His coaching insurance only provided for £lm cover.
How much are you covered for?
The limit of the cover is £5million for any one incident, or where goods are being sold £5 million in any one year.
Civil liability cover extends to:
£5m any one incident
All netball related activities
Clubs, players, officials, coaches, umpires, tutors, volunteers
Anywhere in the world
What does this mean in English?
What this insurance means is that if someone claims that you were reckless in going for a high ball and she broke her leg as a result, you will he covered if you are sued for her loss of earnings and pain and suffering. Similarly, if your club sold sandwiches at a tournament, leading to a mass outbreak of food poisoning, it would also be covered for claims against it. Cover is effected as soon as the County Affiliation Secretary confirms receipt of your Affiliation fees and documents. It is a very good reason to pay your subscriptions promptly, as until they are paid, you are not covered!

Many local authorities require facility hirers to hold insurance and to provide proof of cover. A call to Netball House will see a Confirmation of Insurance on its way to you.
One of the most frequent queries AENA receive is whether the cover extends umpires and coaches. If they are registered participants, then they too are covered - whether officiating in the UK or abroad. So if an umpire allows a match to proceed on an unsafe court, or a coach allows a young player to over train, then they will be covered for any claim against them if they have been negligent. The cover extends to officials working with their own clubs, other clubs, play days or any other netball activity - as it does to all volunteers.
What if trouble is brewing?
As soon you are aware of a problem, get as much information down in writing as you can. Ideally maintain an accident book. Take a note of all witnesses and ask them to write down what they saw. Include match reports and spectators comments. As soon as anyone mentions the possibility of a claim, or you receive a letter from a solicitor, telephone or write to the AENA Chief Executive's office and seek advice. Do not respond to the letter or appoint your own solicitor - you will not be covered for this cost. If the insurers believe that solicitors need to be appointed, they will arrange and pay for this. If you are in any doubt at all then call the Association.
There are some other minor exclusions, but the Civil Liability policy is a wide one and embraces all aspects of sporting and recreational activity. The insurance does not extend to personal accident cover, although team cover can be arranged this year for £28.00. AENA believe that the Civil Liability Cover is one of the greatest attributes of AENA membership and we hope that it will give you the same peace of mind.
